Terms and conditions

1. The promoter of SEDUCEBLACK is Seduce Group Australia Pty Ltd A.B.N. 85 104 625 390 (referred to as “Seduce Group”), which is also the owner of the program. Seduce Group Australia Pty Ltd is located at 51 Princes Highway, St Peters, NSW 2044.

2. The SEDUCEBLACK Membership Card can only be used within Seduce owned retail stores Australia-wide, listed online at www.seduce.com.au and updated from time to time during the currency of the loyalty program.

3. Application for SEDUCEBLACK membership is available to any person residing in Australia. Subject to the terms and conditions, SEDUCEBLACK is a lifetime membership to approved Members. There is no fee for application and registration to become a SEDUCEBLACK member. Seduce reserves the right to implement reasonable administration charges at any time and from time to time.

4. Each Member may not have more than one SEDUCEBLACK Membership. SEDUCEBLACK Membership Cards are not transferable.

5. To earn points from a transaction, the SEDUCEBLACK Member must present their membership card at point of purchase, or advise the sales staff of their Member details and provide acceptable photo identification to the sales staff, otherwise points cannot be attributed to the Member’s account. Where there is any disagreement as to the acceptability of the photo identification produced, the decision of the store manager or sales staff in charge at the time shall be absolute, final and binding. Points cannot be claimed retrospectively.

6. SEDUCEBLACK Member points are calculated and adjusted based on purchases and returns. All returns are subject to the Seduce Refund Policy. There is no refund for change of mind purchase. Seduce only offer an exchange or credit note within 14days from the date of purchase, with a valid store receipt and all swing tickets attached to the garment. Seduce has the absolute right to determine and refuse to accept for return any purchase that is returned more than 14 days after the purchase; has been worn in the opinion of Seduce; or has no defects.

7. Bonus Points may be offered from time to time during special promotions on selected merchandise and can be earned in addition to normal SEDUCEBLACK points.

8. The redemption value of points may be changed at the discretion of Seduce. Any change shall not affect points awarded prior to the date of change.

9. Members of SEDUCEBLACK are responsible for ensuring their Member information, including contact details, provided to Seduce is correct and remains accurate at all times. We may rely upon such information in providing or being able to provide the benefits and services of the SEDUCEBLACK program.

10. Seduce will send or arrange for SEDUCEBLACK Preferred Award Partners to forward the prevailing or then current reward from time to time as posted on the Seduce website, to the SEDUCEBLACK Member who has accumulated the points within a 12 month period for each prevailing or then current reward via the email of the SEDUCEBLACK Member on record with Seduce. Each email contains a voucher for the reward earned with a unique serial number which is required for verification at point of sale at a Seduce store or SEDUCEBLACK Preferred Award Partners store or website as appropriate, which the SEDUCEBLACK Member must provide as a condition to enjoy the reward. The reward voucher without the unique serial number is not valid and a reward voucher can only ever be used in conjunction with the purchase of goods or services from a Seduce store or at a SEDUCEBLACK Preferred Partner as appropriate, and reward voucher(s) can not under any circumstance be redeemed or sought to be compensated for by money.

11. SEDUCEBLACK rewards are valid for six months from the date a SEDUCEBLACK rewards voucher is sent. Seduce is not in any way or can ever be liable where the SEDUCEBLACK Member fails to get the reward voucher(s) timely or at all where the email address of the SEDUCEBLACK Member is wrong, inaccurate or for any reason cannot receive email(s) from Seduce.

12. SEDUCEBLACK Preferred Award Partners may have their own special terms, conditions and/or requirements which SEDUCEBLACK Members acknowledge may be changed from time to time and SEDUCEBLACK members must accept and comply with those special terms in order to participate in the particular SEDUCEBLACK promotions or SEDUCEBLACK rewards program.

13. SEDUCEBLACK Preferred Award Partners do not have any authority, express or implied, to make any representation or statement on behalf of Seduce or the SEDUCEBLACK program, and Seduce accepts no liability in respect of such representations (including omissions), warranties or statements.

14. Seduce will not be held responsible for any misleading offers or failure to honor any advertised offer by a SEDUCEBLACK Preferred Award Partner and SEDUCEBLACK Members’ release and covenant to release Seduce from any claim referable to reward vouchers or offers available or honored for any reason whatsoever by any SEDUCEBLACK Preferred Award Partners.

15. SEDUCEBLACK points are accrued over a 12 month period from the date of initial purchase using a SEDUCEBLACK Membership Card. SEDUCEBLACK Members have 12 months to reach a desired point total in the program. At the end of every 12 months, Member points are zeroed and the point accrual process begins again.

16. Seduce may terminate a membership in the SEDUCEBLACK program without any notice for any reason.

17. A Member may terminate his/her membership in the SEDUCEBLACK loyalty program at any time by giving written notice to Seduce Group Australia Pty Ltd.

18. Seduce reserves the right to change these SEDUCEBLACK Terms and Conditions at any time and from time to time.

19. The SEDUCEBLACK Membership Card is issued by and remains the property of Seduce Group Australia Pty Ltd. Seduce Group Australia Pty Ltd reserves the right to withdraw the card at any time.

20. Seduce reserves the right to alter or amend the conditions of operation of the SEDUCEBLACK program, or terminate the program at any time.

21. SEDUCEBLACK Members in applying, registering, joining or participating in the SEDUCEBLACK Program each acknowledges and agrees that in consideration of Seduce accepting or allowing registration, joining or participation by the Member, the Member or Members each warrants to Seduce that the Member will not participate in any class action in any jurisdiction against Seduce.

22. SEDUCEBLACK Members in applying, registering, joining or participating in the SEDUCEBLACK Program each acknowledges and agrees that in consideration of Seduce accepting or allowing registration, joining or participation by the Member, Seduce can only ever be liable in any claim referable to the SEDUCEBLACK Program substantiated against Seduce to the extent of the reward points and or reward said to be lost in any 12 month period by the Member and Seduce is not required under any circumstance to pay compensation or damages by money and Seduce is only required and obligated to compensate the Member concerned to the extent of the substantiated loss or damage by equivalent reward voucher for use in a Seduce store.

23. SEDUCEBLACK Members in applying, registering, joining or participating in the SEDUCEBLACK Program each further acknowledges and agrees that in consideration of Seduce accepting or allowing registration, joining or participation by the Member, any legal proceeding prohibited under these terms and conditions can only be commenced in an appropriate court or tribunal at the Sydney Registry or District in the State of New South Wales.

24. The laws of the State of New South Wales apply to any dispute or agreement relating to these terms or conditions and the SEDUCEBLACK Program.

25. Each person or Member who applies, joins, registers or participates in the SEDUCEBLACK Program warrants that he/she has relied on any representation or conduct including any omission whatsoever or howsoever and acknowledges that Seduce would have accepted the applying, joining, registering or participation by the person in the SEDUCEBLACK Program had it not been for this warranty.

26. Each person or Member by applying, joining, registering or participating in the SEDUCEBLACK Program acknowledges having read, understand and accepted the terms and conditions of the SEDUCEBLACK Program and is furthermore deemed to have duly read, understood and accepted the terms and conditions.

Privacy policy

1. Seduce Group Australia Pty Ltd ensures the integrity and privacy of each SEDUCEBLACK Member’s details are maintained and upheld at all times and not disclosed to any other organisation for any reason without prior consent from the SEDUCEBLACK Member. We are committed to protecting our customers’ personal information.

2. The information collected from customers will only ever be used to enhance our understanding of SEDUCEBLACK members’ needs and to enable us to communicate more effectively with them.

3. Customers can access the SEDUCEBLACK Member portal online and amend their personal details at anytime via our website using a password chosen by the SEDUCEBLACK Member. The SEDUCEBLACK Member assumes own responsibility at all times for their password and the Member must inform or allow any other person to access for or on behalf of the Member.
